These Terms of Service and Use (“Terms”) govern the use of the website 123website.gr and the services provided by 123website.gr (“Company”, “we”, “us”, “our”), including but not limited to website design, website development, managed hosting, technical support, maintenance, security, domain management, email services, SEO and related digital services.

By using our website and/or services, the Client confirms that they have read, understood and accepted these Terms.

1. Provider details

2. Definitions

For the purposes of these Terms: Client means any natural or legal person who assigns, purchases or uses services provided by 123website.gr. Services means website design, website development, hosting, domain, email, maintenance, technical support, security, SEO, content creation and any related work provided by 123website.gr. Hosting means the hosting of websites, files, databases, emails or other digital resources on a server or infrastructure managed by 123website.gr or by a third-party provider on its behalf. Managed Hosting means hosting accompanied by technical supervision, basic management, monitoring, support and maintenance actions, according to the package or agreement in place. Client Content means any file, text, image, database, email, product, comment, form, code or information that belongs to or concerns the Client and is hosted, published, processed or transmitted through the Services.

3. Nature of the hosting service

123website.gr provides hosting services with a selective and managed approach. The hosting service is not operated as a mass, anonymous shared hosting platform for unknown users. 123website.gr mainly works with Clients it knows, has selected or has undertaken within the context of an overall professional relationship, such as website creation, maintenance, support or digital presence management. 123website.gr reserves the right to reject any request for hosting, website migration or service provision if, at its discretion, the content, technical condition, usage pattern, history, security risk or business activity of the applicant is not compatible with the quality, security and reliability standards of the service.

4. Acceptance of the Terms

Use of the Services provided by 123website.gr requires full acceptance of these Terms. Acceptance may arise indicatively through:
  • assignment of a project or service,
  • payment of an invoice or advance payment,
  • use of hosting, email or technical support,
  • submission of material for publication or management,
  • access to an administration environment,
  • continued use of a service after the publication or update of these Terms.
If the Client does not agree with these Terms, they must not use the Services and must notify 123website.gr in writing.

5. Services provided

Depending on the agreement with the Client, 123website.gr may provide, indicatively, the following services:
  • website design and development,
  • WordPress website development,
  • e-commerce website development,
  • Elementor design and configuration,
  • website hosting,
  • managed WordPress hosting,
  • domain name management,
  • creation and management of email accounts,
  • technical support,
  • WordPress, theme and plugin maintenance and updates,
  • basic website protection and hardening,
  • backup and restoration, where agreed or technically available,
  • connection with third-party services such as Google Analytics, Google Search Console, Cloudflare, SMTP services, payment gateways or booking tools,
  • SEO setup, on-page SEO and content creation,
  • creation of privacy policies, cookie policies and other informational pages, without replacing legal advice.
The exact scope, cost, timeline and level of support are determined on a case-by-case basis through an offer, invoice, email, contract or other written agreement.

6. Client obligations

The Client agrees and undertakes:
  • To provide accurate, complete and up-to-date contact and billing details.
  • To maintain an active contact email and monitor notifications sent by 123website.gr.
  • To use the Services lawfully, in good faith and in accordance with these Terms.
  • Not to use the Services for illegal, harmful, misleading, defamatory, malicious or abusive content or activity.
  • To ensure that they hold all necessary rights for the use of texts, images, videos, logos, fonts, products, trademarks and any other material they provide.
  • To use strong passwords and protect any credentials provided to them.
  • To immediately notify 123website.gr if they become aware of a breach, malicious activity, suspicious access, spam, malware or any technical issue.
  • Not to grant access to third parties without notification or without accepting responsibility for their actions.
  • To maintain their own backups where necessary for business continuity.
  • To pay for the Services on time, according to the agreed payment terms.

7. Access, management and technical support

123website.gr may access the Client’s files, databases, WordPress installation, hosting account, email, domain, DNS or other technical environments where necessary for:
  • providing technical support,
  • maintenance,
  • troubleshooting,
  • security actions,
  • website migration,
  • installation or configuration of services,
  • compliance with a lawful request from a competent authority.
Such access is carried out only to the extent necessary for the provision of the Service and in accordance with the Privacy Policy of 123website.gr. The Client acknowledges that any technical instructions, recommendations or suggestions provided outside the agreed scope are offered in good faith and do not constitute a guarantee of a specific result.

8. Acceptable use

The Services of 123website.gr are intended for lawful professional, commercial, informational or personal use. The Client agrees not to use the Services for:
  • violation of Greek, European or international law,
  • infringement of copyrights, trademarks or third-party rights,
  • sending spam or unsolicited bulk email,
  • phishing, malware, viruses, trojans, worms or other malicious software,
  • misleading websites or fraudulent activity,
  • DDoS attacks, port scanning, brute force attacks, spoofing or other offensive techniques,
  • hosting illegal, offensive, threatening, defamatory or obscene content,
  • content that promotes violence, hatred, discrimination or exploitation of minors,
  • distribution of illegal software, warez, cracks, serial keys or hacking instructions,
  • illegal gambling or activities requiring special licensing where such licensing is not held,
  • activities that excessively burden or endanger the server, network, IP reputation or other Clients.
123website.gr reserves the right to review, restrict, isolate, suspend or terminate any Service that violates these Terms or endangers the security, reputation, availability or legality of the infrastructure.

9. Email, contact forms and message sending

Email services, where provided, are intended for normal professional or personal use and not for mass newsletter sending, advertising campaigns or automated bulk campaigns, unless a specific solution has been agreed. The Client must:
  • use secure passwords,
  • not send spam,
  • not use misleading headers or false sender details,
  • not use the hosting service for bulk email without approval,
  • properly configure SMTP authentication for website forms,
  • notify 123website.gr if suspicious email activity is detected from their account.
If an email account, contact form or script causes spam, blacklisting, abuse reports or technical overload, 123website.gr may temporarily suspend email sending, disable the relevant form or request technical corrections before restoring the service.

10. Security, malware and compromised websites

123website.gr takes reasonable technical and organisational measures to protect its infrastructure and the websites it hosts or manages. However, no hosting service, CMS, plugin, theme, server or web application can be considered completely immune to security risks. If a Client’s website or account:
  • is compromised,
  • contains malware,
  • sends spam,
  • participates in attacks,
  • hosts phishing content,
  • causes overload or risk to the server,
  • endangers other services or Clients,
123website.gr may, without prior notice where an urgent technical or legal issue exists, proceed with temporary suspension, isolation, file deactivation, password reset, access restriction or any other necessary protective action. Restoration, cleanup, rechecking or repair of a compromised website may be charged separately, unless expressly covered by an active maintenance or technical support package.

11. WordPress, plugins, themes and third-party software

The Client acknowledges that many projects rely on third-party software, such as WordPress, Elementor, WooCommerce, plugins, themes, payment gateways, booking tools, APIs, Cloudflare, Google services or other external systems. 123website.gr is not responsible for:
  • functional changes in third-party software,
  • incompatibilities after updates,
  • removal of features by third-party providers,
  • plugin or theme errors,
  • issues caused by unlicensed or outdated software,
  • pricing changes by third parties,
  • outages, restrictions or failures of third-party services.
Where 123website.gr undertakes WordPress maintenance, updates are performed with reasonable care. Nevertheless, additional work may be required in case of incompatibility, errors, plugin/theme changes or restoration needs.

12. Hosting policy, security measures, backups and data restoration

Hosting and technical support services are provided within the framework of the infrastructure, operational procedures and security practices applied by 123website.gr, in accordance with the applicable Service Provision, Security and Operational Policy published on the official website of 123website.gr. This policy forms an integral part of the service relationship with the Client and remains available to Clients through the website. 123website.gr reserves the right to unilaterally modify, update or improve this policy for technical, operational, regulatory compliance or security reasons. The version in force at any given time applies from the moment it is published on the website. Continued use of the Services after publication or notification of updates constitutes acceptance of the updated policy.

12.1 Technical and organisational security measures

123website.gr applies appropriate technical and organisational measures for the protection of the systems, hosted data and, where applicable, personal data processed on behalf of the Client. These measures may include, depending on the service and infrastructure used, the following:
  • server-level firewall and access restriction rules,
  • malware detection and security monitoring tools,
  • regular operating system and server software updates,
  • controlled administrative access to hosting environments,
  • SSL/TLS certificates where applicable,
  • backup procedures for service restoration and business continuity,
  • basic hardening practices for hosted websites and WordPress installations,
  • DNS and Cloudflare configuration support where applicable,
  • email authentication configuration such as SPF, DKIM and DMARC where technically available.

12.2 Backups

Regular backups are maintained for hosted systems and data, with the purpose of supporting availability and integrity in the event of a technical incident, service failure or data loss. Backups may be stored on protected storage media and/or remote offsite storage infrastructure with controlled access. Backups are used exclusively for restoration, recovery and business continuity purposes. Backups are an important protective measure but do not constitute an absolute guarantee that every file, email, database, transaction, order, form submission or change will be recoverable at any specific point in time. The Client is encouraged to maintain their own independent backups where the hosted content is critical to their business operations.

12.3 Updates and patch management

123website.gr applies a process of regular security updates to the operating system, server software, hosting management systems and core infrastructure components. These updates may include vulnerability fixes, security patches and critical updates intended to reduce known security risks and maintain the stability and integrity of the hosting environment. Where updates concern third-party applications, plugins, themes or software installed on the Client’s website, additional work may be required and may be charged separately unless such work is expressly included in an active maintenance agreement.

12.4 Malware handling

123website.gr uses tools and procedures for the detection and protection against malicious software, where technically available and appropriate. In the event that malicious code, malware or suspicious activity is detected, 123website.gr may proceed with technical inspection and cleanup, restoration and hardening actions, restriction of access where required, suspension or isolation of affected files or services, and any other reasonable measure necessary to protect the hosted environment. Where an incident may affect personal data, the Client will be informed without undue delay, to the extent that the incident is identified and falls within the responsibility or technical visibility of 123website.gr. Malware cleanup, advanced investigation, hardening, restoration or repair work may be charged separately, unless expressly covered by an active maintenance, security or technical support package.

12.5 Access control

Access to servers, hosting management systems, storage infrastructure and administrative tools is restricted to authorised persons and only to the extent necessary for the performance of their duties. Where a technical issue cannot be managed directly by 123website.gr, access or technical intervention may be required by authorised personnel of infrastructure or software providers, such as Hetzner or cPanel, strictly for the purpose of troubleshooting, infrastructure support or service restoration. Strong authentication, controlled access practices and access logging are used where technically feasible. Access credentials are handled confidentially and securely.

12.6 Backup retention

Backups are retained for a predefined and limited period, according to the retention policy applied by 123website.gr and the operational needs of service restoration. After the applicable retention period has expired, backups may be automatically deleted, rotated or replaced by newer backup copies, unless otherwise required by law or by a specific written instruction or agreement with the Client. The restoration of a backup may replace newer data with older data and may affect files, databases, emails, orders, products, form submissions or other website data. For this reason, restoration actions are performed with reasonable care and, where possible, after communication with the Client.

13. Service availability and maintenance

123website.gr makes reasonable efforts to keep hosting services and managed websites available and operational. However, availability may be affected by:
  • scheduled or emergency maintenance,
  • server upgrades,
  • DNS changes,
  • data center issues,
  • DDoS attacks or malicious activity,
  • hardware or software failures,
  • application or plugin errors,
  • third-party provider issues,
  • internet connectivity problems,
  • force majeure events.
Where feasible, 123website.gr informs the Client of scheduled work that may materially affect the operation of the Service. 123website.gr does not guarantee uninterrupted, continuous or error-free operation, unless a specific SLA has been agreed in writing.

14. Domain names and DNS

123website.gr may provide domain name registration, renewal, transfer or technical management services, either directly or through third-party registrars. The Client acknowledges that:
  • domain registration is subject to the rules of the relevant registry or registrar,
  • domain renewal requires timely payment,
  • failure to renew may result in expiration, deactivation, loss of the domain or additional restoration costs,
  • DNS changes may require propagation time,
  • 123website.gr is not responsible for delays or rejections caused by third-party registrars, registries or inaccurate Client details.
If the domain is registered in the Client’s name, the Client remains responsible for the accuracy of the details and timely renewal, unless they have assigned management to 123website.gr in writing.

15. Client Content and intellectual property

The Client retains ownership of the content they provide to 123website.gr, unless otherwise agreed. The Client declares that they have the right to use, publish and process any material they provide, including texts, images, photographs, videos, logos, files, products, price lists and other elements. 123website.gr is not responsible for copyright, trademark or third-party rights infringements arising from material provided or approved by the Client. Material, design, graphics, structures, texts, code or creative work produced by 123website.gr remain the property of 123website.gr until the relevant project has been paid in full, unless otherwise agreed in writing. After full payment, the Client obtains the right to use the deliverable for the agreed purpose. The Client does not necessarily acquire rights to resell, redistribute or commercially exploit individual templates, code, processes or know-how of 123website.gr, unless expressly agreed in writing.

16. Prices, payments and renewals

Prices for Services are determined on a case-by-case basis through an offer, invoice, email, contract or other written agreement. 123website.gr may request an advance payment before starting work or full payment before delivery, migration, publication or activation of a Service. Annual services such as hosting, domains, email, maintenance or software licences are renewed only if paid on time. In case of delayed payment, 123website.gr reserves the right to:
  • temporarily suspend the Service,
  • restrict access to administration tools,
  • stop maintenance or support work,
  • not renew domains, hosting or third-party services,
  • delete Services after reasonable notice, where permitted by law and by the relevant agreement.
Taxes, VAT, third-party fees, domain costs, software licences, premium plugins, stock images, subscriptions or external services are charged separately, unless expressly stated as included.

17. Cancellations, termination and service transfer

The Client may request termination of a Service or transfer of a website/domain, provided that there are no outstanding financial obligations. Requests for termination or transfer must be made in writing via email. 123website.gr may terminate or refuse to provide Services if:
  • these Terms are violated,
  • there are overdue payments,
  • the Service is used illegally or abusively,
  • there is risk to the security or reputation of the infrastructure,
  • the Client provides false information,
  • the cooperation becomes technically, legally or professionally unsustainable.
In case of termination, the Client must request a copy of their files in good time, provided that such files are available and that no legal or technical restrictions apply. 123website.gr is not obliged to retain data indefinitely after expiration, termination or non-renewal of a Service.

18. Refunds

Refunds are reviewed on a case-by-case basis, depending on the nature of the Service. As a general rule, no refunds are provided for:
  • work already performed,
  • domain names already registered or renewed,
  • software licences or third-party services already purchased,
  • hosting that has already been activated or used,
  • technical work, configurations, migrations or restorations,
  • Services terminated due to violation of these Terms.
Any special refund arrangement must be confirmed in writing.

19. Third-party services

123website.gr may use or connect services provided by third parties, including indicatively:
  • domain registrars,
  • data centers,
  • server providers,
  • Cloudflare,
  • Google services,
  • payment gateways,
  • SMTP providers,
  • analytics tools,
  • booking engines,
  • premium plugins,
  • stock media providers.
Use of these services is subject to the terms of the respective third-party providers. 123website.gr is not responsible for outages, changes, restrictions, charges, technical problems or decisions of third-party providers, but will make reasonable efforts to support and resolve issues within its area of management.

20. Limitation of liability

123website.gr makes every reasonable professional effort to provide reliable Services. However, to the maximum extent permitted by applicable law, 123website.gr is not liable for:
  • loss of profits,
  • loss of data,
  • loss of sales,
  • interruption of business activity,
  • malfunction of third-party services,
  • cyberattacks,
  • errors in third-party software,
  • delays caused by third-party providers,
  • hardware failures,
  • connectivity or DNS issues,
  • damages arising from actions or omissions of the Client or third parties acting on their behalf.
In any case, any liability of 123website.gr is limited to the amount paid by the Client for the specific Service from which the issue arose, unless the law provides otherwise.

21. Client responsibility and indemnification

The Client agrees to indemnify and hold 123website.gr harmless against any claim, demand, damage, fine, court or out-of-court expense, legal fee or other cost arising from:
  • unlawful use of the Services,
  • violation of these Terms,
  • infringement of third-party rights,
  • content provided or approved by the Client,
  • activity by third parties who obtained access through the Client,
  • spam, malware, phishing or other abuse originating from the Client’s account, website or Service.

22. Personal data and confidentiality

Personal data is processed in accordance with the Privacy Policy of 123website.gr and applicable data protection legislation. 123website.gr takes reasonable measures to protect the data it manages within the context of its Services. The Client remains responsible for the legality of the collection and processing of personal data carried out through their own website, including contact forms, bookings, orders, newsletters, analytics, cookies and other functions. Where required, the Client must maintain an appropriate Privacy Policy, Cookie Policy, consent mechanism and other legal notices.

23. Legal texts and compliance support

123website.gr may assist in creating basic informational texts, such as Privacy Policies, Cookie Policies, Terms of Use or GDPR-related notices, based on information provided by the Client. Such texts are provided as practical content support and do not replace personalised legal advice from a qualified lawyer. The Client is responsible for having the final accuracy, completeness and suitability of legal texts reviewed by a legal advisor for their specific business.

24. Force majeure

123website.gr is not liable for delay, inability to perform or interruption of Services caused by events beyond its reasonable control, including indicatively:
  • natural disasters,
  • fires,
  • floods,
  • war,
  • terrorist acts,
  • strikes,
  • power outages,
  • telecommunications failures,
  • data center failures,
  • cyberattacks,
  • decisions of public authorities,
  • outages or restrictions imposed by third-party providers.

25. Changes to these Terms
